Audio Video Training
As an Officer, can I secretly record audio of people I talk to?
I asked my sergeant if I could keep a recorder running in my pocket on traffic stops or when I talk to citizens without their consent. He said no I have to inform them that I am recording them. I brought up that we have (in two of our cars) video and audio dash cam and that we never tell people that we are recording them there.
I am in training still and have only been an officer for a month, I leave for the academy in a couple weeks. I was just curious about this since you can get a small 4 Gig mp3 recorder for $50 and you pretty much could leave it recording all day for months with that amount of memory. It seems like a great way to CYA or if you interview someone and can't recall something. I read through our policy manual and couldn't find anything about it. Also, I live in Oregon.
Your sergeant doesn't know what he is talking about. Yes, you can record your contacts as long as you are doing so for the sole purpose of preserving best evidence. Meaning any statements made to prove (or disprove) your investigation. In fact, in this day and age, I'd say if you are a cop and don't record your contacts you are dumb. There is no reason not to, and it will save your butt one day. Watch this great video:

Bottom line, I ALWAYS record contacts. It has helped prove what happend, vs. what the citizen says happened. Look up your states evidence laws and tell your sergeant he is wrong. You are PRESERVING BEST EVIDENCE for the court.
