Living Will Made
If you are given a house as a beneficiary to an estate AFTER a Will has been made is it yours to keep or do?
you have to give it over to the estate if the benefactor has been living in it for approx a year? My brother signed it on to me BUT the will dated many years ago says that the house is to be sold and divided or does that only refer to the house he lived in at the time the Will was made? Probate is so complicated it drives you nuts.
The deeds are on my name and I pay the council tax also...but he lived in it till he [passed away in a hospital though he had given me the house which is free from mortgage.
I take it your brother has passed on now. Sorry to hear that.
As far a probate goes, I'd really suggest you seek proper advice from a solicitor. It IS complicated, as you say, and you need to get it right. Most solicitors will give you the initial interview free, at least.
Regarding passing the house on to you, there are implications in that and only a solicitor can tell you exactly what they are.
